When Is it Medical Negligence?
Medical negligence occurs when a doctor or other health care provider violates the standard of care. Some cases are considered negligence per se. When a doctor commits the surgical error of leaving a sponge or clamp in the body cavity, this error is considered negligence per se.
Some medical negligence cases, however, are more complex. Every medical complication is not necessarily medical negligence. If the complication is known by your physician and he or she has not promptly dealt with the matter, it could be considered medical malpractice.
